This is the privacy notice of Kim Nilsson Ltd. In this document, "I", "me", or "my" refers to Kim Nilsson and any services provided by Kim Nilsson MIAB, AIAAP through Kim Nilsson Ltd..

Introduction

1.                 This privacy statement informs you about how I process information that I record about you, whether provided by you, or by another person or organisation. In the context of the law and this notice, “process” means collect, store, transfer, use or otherwise act on information.

2.                 I am committed to the protection of your privacy and confidentiality. I recognise that you are entitled to know that your data will not be used for any unintended purpose, and will not accidentally fall into the hands of a third party.

3.                 I undertake to preserve the confidentiality of all information you provide to us, and hope that you reciprocate.

4.                 I have in place procedures and training for data protection, confidentiality and information security. These are regularly reviewed to ensure that they remain effective.

5.                 My policy complies with UK law accordingly implemented, including that required by the EU General Data Protection Regulation (GDPR).

6.                 The law requires me to tell you about your rights and my obligations to you in regards to the processing and control of your personal data. I do this now, by requesting that you read the information provided at www.knowyourprivacyrights.org

7.                 Except as set out below, I do not share, or sell, or disclose to a third party, any information collected through our website.

8.                 Data I process

I provide a range of services to businesses and personal clients. I aim to process data, whether personal data or not, only to the extent necessary for me to provide my clients with my services and for other agreed purposes.

Often I may aggregate information in a general way and use it to provide class information. If I use it for this purpose, you as an individual will not be personally identifiable.

Personal clients

If you are a personal client, personal data that I may process may include contact information, information about your business activities, information about your family members, and financial information such as that relating to your income, expenses, taxation and investments. Some of my services may also require me to process information deemed to be “special category” information. In most cases, your personal data will have been provided to me by you. However, with your consent, or if it is necessary in order to provide you with my services, I may have obtained your personal data from a third party source.

Third parties connected to clients and suppliers

I may process your personal data if you have a personal or business connection with any of my clients or suppliers. For example, you may be a family member, business partner, other adviser, supplier or transaction counterparty.

The data I process may include contact information, information about business activities, information about partners, directors, employees, information relating to employment remuneration and payroll, and financial information such as that relating to income, expenses, taxation and investments.

I may be given your personal data by our clients or suppliers, or by third parties acting on the instructions of a client or a supplier.

I ask my clients and suppliers to bring this privacy notice to your attention as soon as they become aware that we process your personal data.

Suppliers

If you supply my business with goods or services, including subcontracted services that I supply to our clients, then I may process your personal information. However, I do so only to the extent necessary to contract with you.

In most cases, your personal data will have been provided to me by you. However, sometimes I use third parties such as credit rating agencies to make decisions regarding our relationship.

The bases on which I process personal information

The law requires me to determine under which of six defined bases I process different categories of your personal information, and to notify you of the basis for each category.

If a basis on which I process your personal information is no longer relevant then I shall immediately stop processing your data.

If the basis changes then if required by law I shall notify you of the change and of any new basis under which I have determined that I can continue to process your information.

9.                 Information I process because we have a contractual obligation

I may process personal information when a contract has been formed with my business and processing is necessary to carry out my obligations under that contract, or when processing personal data is necessary in order to form a contract.

I shall continue to process this information until the contract between us ends or is terminated by either party under the terms of the contract.

10.              Information I process with your consent

Only when you have given me explicit permission to do so, do I process your personal information under the basis of consent.

For example, you might have agreed that I may pass your name and contact information to selected associates whom I consider may provide services or products you would find useful.

I continue to process your information on this basis until you withdraw your consent or it can be reasonably assumed that your consent no longer exists.

You may withdraw your consent at any time by instructing me at kimnilssonbookkeeper@yahoo.co.uk. However, if you do so, you may not be able to use my website or my services further.

11.              Information I process for the purposes of legitimate interests

I may process information on the basis there is a legitimate interest, either to you or to me, of doing so.

Where I process your information on this basis, I do after having given careful consideration to:

·                  whether processing (or not processing) might cause you harm

·                  whether you would expect me to process your data, and whether you would, in the round, consider it reasonable to do so

For example, I may process your data on this basis for the purposes of:

·                  responding to communication from you to which I believe you would expect a response

·                  protecting and asserting the legal rights of any party

·                  insuring against or obtaining professional advice that is required to manage business risk

·                  protecting your interests where I believe I have a duty to do so

12.              Information I process because I have a legal obligation

Sometimes, I must process your information in order to comply with a statutory obligation.

For example, I may be required to give information to legal or tax authorities if they so request or if they have the proper authorisation such as a search warrant or court order.

This may include your personal information.

Specific uses of information you provide to me

13.              Communicating with you

When you contact me, whether by telephone, through my website or by e-mail, I collect the data you have given to me in order to reply with the information you need.

I record your request and my reply in order to increase the efficiency of my business.

I keep personally identifiable information associated with your message, such as your name and email address so as to be able to track my communications with you to provide a high quality service.

14.              Dealing with complaints

When I receive a complaint, I record all the information you have given to me.

I use that information to resolve your complaint.

If your complaint reasonably requires me to contact some other person, I may decide to give to that other person some of the information contained in your complaint. I do this as infrequently as possible, but it is a matter for my sole discretion as to whether I do give information, and if I do, what that information is.

If the complaint relates to information on omy website and I feel it is justified or if I believe the law requires us to do so, I shall remove the information while I investigate.

If I think your complaint is vexatious or without any basis, I shall not correspond with you about it.

I may compile statistics from information relating to complaints to assess the level of service we provide, but not in a way that could identify you or any other person.

15.              Customer relationship management system

I use a customer relationship management (CRM) system to process personal data.

Data subjects include existing, former and prospective clients and their agents and representatives.

Personal data that I process includes the name of the person, information about his or her employer and job position, and contact information.

I process this data on the basis of consent for purposes that include:

·        managing and developing our business or services

·        informing clients and prospective clients about our services

·        determining relationships between clients and our partners and employees

·        analysing whether we provide clients with a high level of service

I do not sell or share any personal data with third parties unless I have explicit consent to do so from the data subject.

16.              Job applications and employment

If you send us information in connection with a job application, I may keep it for up to three years in case I decide to contact you at a later date.

If I employ you, I collect information about you and your work from time to time throughout the period of your employment. This information will be used only for purposes directly relevant to your employment. After your employment has ended, I will keep your file for six years before destroying or deleting it.

Use of information I collect through automated systems when you visit my website

17.              Cookies

Cookies are small text files that are placed on your computer's hard drive by your web browser when you visit any website. They allow information gathered on one web page to be stored until it is needed for use on another, allowing a website to provide you with a personalised experience and the website owner with statistics about how you use the website so that it can be improved.

Some cookies may last for a defined period of time, such as one day or until you close your browser. Others last indefinitely.

Your web browser should allow you to delete any you choose. It also should allow you to prevent or limit their use.

Our website uses cookies. They are placed by software that operates on our servers, and by software operated by third parties whose services we use.

17.2.          to record whether you have seen specific messages I display on my website

17.4.          to record your answers to surveys and questionnaires on my site while you complete them

17.5.          to record the conversation thread during a live chat with my support team

18.              Personal identifiers from your browsing activity

Requests by your web browser to my server providers for web pages and other content on my website are recorded.

They record information that could identify your location, such as your IP address. They also record information reported by the software you are using to browse my website, such as the type of computer or device and the screen resolution.

They use this information in aggregate to assess the popularity of the webpages on my website and how it performs in providing content to you.

If combined with other information they know about you from previous visits, the data possibly could be used to identify you personally, even if you are not signed in to my website. However, my policy is not to use such data for the purpose of personal identification.                                    

Disclosure and sharing of your information

19.              Information I obtain from third parties

Although I do not disclose your personal information to any third party (except as set out in this notice), I sometimes receive data that is indirectly made up from your personal information from third parties whose services I use.

20.              Third party advertising on my website

Third parties may advertise on my website. In doing so, those parties, their agents or other companies working for them may use technology that automatically collects information about you when their advertisement is displayed on my website.

They may also use other technology such as cookies or JavaScript to personalise the content of, and to measure the performance of their adverts.

I do not have control over these technologies or the data that these parties obtain. Accordingly, this privacy notice does not cover the information practices of these third parties.

21.              Data may be processed outside the European Union

My website is hosted in the United Kingdom.

I may also use outsourced services in countries outside the European Union (EU) from time to time in other aspects of our business.

Accordingly data obtained within the UK or any other country could be processed outside the EU.

I use safeguards with respect to data transferred outside the EU.

Access to your own information

22.              Access to your personal information

22.1.          At any time you may review or update personally identifiable information that I hold about you.

22.3.          After receiving the request, I will tell you when I expect to provide you with the information, and whether I require any fee for providing it to you.

24.              Verification of your information

When I receive any request to access, edit or delete personal identifiable information I shall first take reasonable steps to verify your identity before granting you access or otherwise taking any action. This is important to safeguard your information.

Except as otherwise mentioned in this privacy notice, I keep your personal information only for as long as required by me:

25.1.          to provide you with the services you have requested;

25.2.          to comply with other law, including for the period demanded by UK tax authorities;

25.3.          to support a claim or defence in court.

26.              If you are not happy with my privacy policy

26.1.          If you are not happy with my privacy policy or if have any complaint then you should tell me.

26.2.          If a dispute is not settled then I hope you will agree to attempt to resolve it by engaging in good faith with me in a process of mediation or arbitration.

26.3.          If you are in any way dissatisfied about how I process your personal information, you have a right to lodge a complaint with the Information Commissioner's Office. This can be done at https://ico.org.uk/concerns/

27.              Compliance with the law

My privacy policy has been compiled so as to comply with the law of every country or legal jurisdiction in which I aim to do business. If you think it fails to satisfy the law of your jurisdiction, I should like to hear from you.

28.              Review of this privacy policy

I may update this privacy notice from time to time as necessary. The terms that apply to you are those posted here on my website on the day you use our website. I advise you to print a copy for your records.
